Welcome to Solyra® Moroccan Lanterns! These Terms of Service ("Terms") govern your access to and use of the website https://solyramoroccan.com (the "Site") and all products and services offered by Solyra® Moroccan Lanterns ("we," "our," or "us").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.

1. Acceptance of Terms

By using our Site, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use our Site.

2. Eligibility

You must be at least 18 years old to use our Site and purchase products. By using our Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Responsibilities

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Product Descriptions and Pricing Accuracy

We strive to be as accurate as possible in the descriptions of our products, including the "Solar Moroccan Lanterns." However, we do not warrant that product descriptions or other content on the Site are entirely accurate, complete, reliable, current, or error-free. Please note that our garden solar lights are primarily for decorative purposes and may not illuminate an entire area. The unique projection patterns are copyrighted. All product images are for illustrative purposes only. Actual products may vary slightly.

All prices are subject to change without notice. While we try to ensure all prices displayed are accurate, errors may occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you, we will treat the order as canceled.

5. Order Acceptance and Cancellation Rights

Your placement of an order does not necessarily assure that we will accept your order. We reserve the right to refuse or cancel any order at our sole discretion. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

6. Payment Terms

All payments must be made in full at the time of purchase. We accept various payment methods as indicated on our Site. By submitting an order, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your order (including taxes and shipping fees) to that payment method.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, product designs (such as the unique projection patterns of our lanterns), and software, is the property of Solyra® Moroccan Lanterns or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. The compilation of all content on this Site is the exclusive property of Solyra® Moroccan Lanterns. You may not use any content from the Site without our express written permission.

IN NO CASE SHALL SOLYRA® MOROCCAN LANTERNS, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICE OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY.

OUR SOLAR MOROCCAN LANTERNS ARE DESIGNED FOR DECORATIVE PURPOSES ONLY AND ARE NOT INTENDED TO PROVIDE PRIMARY ILLUMINATION. WE ARE NOT RESPONSIBLE FOR ANY DAMAGES OR INJURIES RESULTING FROM THE MISUSE OR IMPROPER INSTALLATION OF OUR PRODUCTS.

10. Indemnification

You agree to indemnify, defend and hold harmless Solyra® Moroccan Lanterns and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

11. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the state in which Solyra® Moroccan Lanterns is registered, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in the state in which Solyra® Moroccan Lanterns is registered, in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. Judgment upon the award rendered by such arbitrator may be entered in any court of competent jurisdiction.

12. Severability Clause

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
